Terms of Service

These terms govern your use of GitPushups, a service provided by MeMeTiMe LLC ("Company"). By using GitPushups you agree to the following:

• No warranty. GitPushups is offered "as is" and Company assumes no liability for damages or losses arising from its use.
• Data analytics. You consent to allow your data to be used in third-party product analytics platforms that help us improve the service.
• Security. While we implement reasonable measures to protect your data from bad actors, no system is perfectly secure and you accept all risk associated with using GitPushups.

Continued use of the service constitutes acceptance of these terms.

End User License Agreement (EULA)

General

• License. Subject to these terms, Company grants you a limited, non-exclusive, non-transferable, revocable license to install and use GitPushups on devices you own or control for your personal, non-commercial use.
• Third-Party Terms. You must comply with all applicable third-party terms when using GitPushups (e.g., wireless data service agreements, platform terms, and open-source licenses used by the app).
• Legal Compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country and that you are not listed on any U.S. Government list of prohibited or restricted parties.

iOS (Apple App Store) Terms

1. Acknowledgement. This EULA is between you and MeMeTiMe LLC only, not Apple. MeMeTiMe LLC, not Apple, is solely responsible for GitPushups and its content. This EULA may not conflict with the Apple Media Services Terms and Conditions.
2. Scope of License. Your license is non-transferable to use GitPushups on Apple-branded products you own or control and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, including Family Sharing or volume purchasing.
3. Maintenance & Support. MeMeTiMe LLC is solely responsible for maintenance and support for GitPushups. Apple has no obligation to furnish any maintenance or support services.
4. Warranty. MeMeTiMe LLC is solely responsible for any product warranties, express or implied by law. If GitPushups fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligations; all other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are MeMeTiMe LLC’s responsibility.
5. Product Claims. MeMeTiMe LLC is responsible for addressing any claims by you or a third party relating to GitPushups or your possession and/or use of it, including (i) product liability; (ii) failure to conform to legal or regulatory requirements; and (iii) claims arising under consumer protection, privacy, or similar laws (including any use of HealthKit/HomeKit if applicable). Liability will not be limited beyond what is permitted by law.
6. Intellectual Property. In the event of any third-party claim that GitPushups or your possession and use of it infringes intellectual property rights, MeMeTiMe LLC is solely responsible for the investigation, defense, settlement, and discharge of such claim.
7. Third-Party Beneficiary. You and MeMeTiMe LLC acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of this EULA and that, upon your acceptance of the EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you.

Android (Google Play) Terms

• Store Relationship. This EULA is between you and MeMeTiMe LLC only. Google is not a party to this EULA and has no responsibility for GitPushups or its content.
• Scope of License. Subject to these terms and any applicable Google Play policies, your license is non-exclusive and non-transferable to install and use GitPushups on Android devices you own or control.
• Maintenance & Support. MeMeTiMe LLC is solely responsible for providing maintenance and support for GitPushups. Google has no obligation to furnish any maintenance or support services.
• Warranty & Product Claims. MeMeTiMe LLC is solely responsible for any product warranties (to the extent not effectively disclaimed) and for addressing any claims by you or third parties relating to GitPushups or your possession and/or use of it (including product liability, legal/regulatory compliance, and consumer protection or privacy claims).
• Intellectual Property. In the event of any third-party claim that GitPushups or your use of it infringes intellectual property rights, MeMeTiMe LLC is solely responsible for the investigation, defense, settlement, and discharge of such claim.
• Third-Party Beneficiary (Android). To the extent permitted by applicable terms, you acknowledge and agree that Google LLC and its subsidiaries may be third-party beneficiaries of this EULA with the right to enforce relevant provisions against you in connection with your use of GitPushups obtained via Google Play.
• Compliance with Google Play Policies. Your use of GitPushups must comply with the Google Play Terms of Service and policies (including payment/refund rules that apply to your region).
